Former Police Chief Herbst Sentencing Postponed

ManvilleToday was in the courtroom this morning, June 19th, at what was to be the sentencing of former Manville Police Chief Thomas Herbst. There were two motions scheduled: Judgment of Acquittal and Sentencing.
As you may recall, in February, a jury unanimously found former Chief Herbst guilty of:
- Four counts of official misconduct second degree
- One count of pattern of official misconduct second degree
- One count of sexual assault second degree
- One count of criminal sexual contact fourth degree
Sentencing was originally scheduled for April 10th. Then, it was pushed back to May, and then further pushed back to June.
When the Court was called into session this morning, Mr. Herbst's attorney presented the motion for judgment of acquittal.
After hearing from attorneys on both sides, the Judge indicated he would require a few days to review and draft his response to the motion. This would postpone the sentencing portion of the hearing.
The prosecution and Judge were wanting the sentencing hearing scheduled in early July, however, the defense attorney would not be available for the dates given.
After the attorneys and Judge reviewed their schedules, the Judge set a new sentencing date for August 12th.
